PC is Denial

Banned from Facebook again for suggesting the protesters at the Kavanaugh Senate hearing should be tasered. So, I will have a lot more time for these messages for 4 weeks. I can speak with authority on this Honor Society, as someone who barely passed med school, and did the absolute minimum. 

A denier has an agenda. Argument with fact and logic has no influence, because they do not argue in good faith. Only an ass kicking remains. All deniers are anti-Israel, as well, including denier Jews. 

Because there are millions of such asses to kick, the better remedy is the attack on government support. These schools are privileged with tax exemption, tax free grants, and other privileges. These privileges are for the purpose of education. In education, all aspects of a subject are presented. If one side of a subject is allowed, that is called indoctrination. All government privileges and support should end until education is restored, and racial discrimination against Asians is stopped. I would like to see the Trump IRS end the tax exemption of this medical school, and immediately stop all federal grant payments. The government should not be subsidizing indoctrination and discrimination. 

In reality, this is a nativist attacks on Asians, and discriminatory. As I recall, from a medical school graduation, the awards went to a lot dark skinned Asians. You could get half the class to turn to you by yelling, Dr. Patel. As an alum parent, I was seated on the stage. I turned to the high official next to me, and said, "Finally. A white guy." He did not find me funny. 

Mt Sinai is the school of the German Jews. Einstein is the school of the Russian Jews. It was started because the German Jews have a superiority complex. They need to be taken down a notch by their neighbor, down Fifth Avenue, Donald Trump. 

Here is my denier screening question. It is very accurate. I would ask it of the student in the article. These are questions settled by the facts. Any hesitation means, denier. 

Was 9/11 a CIA/Mossad operation? Were the outbuildings destroyed by timed explosions as one may see in a planned demolition?

False Allegations by Feminists and by Their Male Running Dogs

I made a point that to prevent getting raped, women should avoid high risk situations, for example the vicinity of criminals and of alcoholics. It was in the context of a movie about the large fraction of Native American females who were raped. I pointed out the three fold higher rate of alcoholism in their males.

As a result, dozens of feminists, and dozens of their male running dogs accused me of being a rapist, and a pedophile. The fraction of false allegations in that instance was 100%. If the rate of false allegations against a stranger the feminist has never met is 100%, and who has done nothing to them, what is it if they hold a grudge against a guy? For example, they made him feel terrible, and he wants nothing to do with them. They are angry and frustrated by his rejection, and now they make an allegation of rape or of sexual abuse.

Nor, am I committing an Exception Fallacy, attributing a feature found in a few. The allegations were by the dozens, and even by the majority of the commentators.

All allegations of sexual abuse, assault or harassment should be screened with a polygraph examination, prior to the start of an expensive and time consuming investigation. If a false allegation is made to a government official, that is a crime. It should be prosecuted. There should be a mandatory sentence like that of Martha Stewart for lying about getting a phone call warning her to sell her shares. She made that statement to the FBI, in an informal conversation, in her living room, not under oath. She was sentenced to 5 months in prison, 5 months house arrest, and 2 years of probation, not for insider trading, but for her false statement to a government official about a phone call.

The accusation of a sexual assault is far more damaging, and the punishment should be proportional to the damages to the defendant. If a school or an employer believes the false allegation, and launches a false investigation, then they should be sued for all legal costs, including any trial costs,
for damages to the reputation of the defendant, and for his mental distress. If they are biased, or had knowledge, or should have known, exemplary damages, usually triple, are legally justified. To deter.

Remedies for False Allegations of Rape

Washington Post report on Rolling Stone settlement with U of Virginia official after false allegation of rape, and false allegation of indifference by the university to the allegation of rape.

Martha Stewart spent 5 months in prison, 5 months on house arrest, and years on probation not for insider trading, but for lying about not receiving a phone call, to FBI agents, at her home, in an informal interview, not under oath.

All false allegations of rape should result in the same charge and sentencing. All false allegations should result in tort liability of the false accuser, of any newspaper reprinting the false allegations, and of any police or prosecutorial agency, falsely prosecuting such allegations.

Once the false accuser is convicted, the tort liability should be automatic. The sole question for any tribunal should be the value of any damage to the falsely accused.

Iowa Legislator Wants Party Registration Balance in University Faculty Hiring 

Who is smarter, the rich or the poor? Who is more likely to vote Republican, the rich or the poor? The rich are too intelligent to teach. The lower functioning, left wing faculty is merely reporting on the achievements of the intelligent rich to their students, no matter the subject matter. Forcing universities to find greater balance would force them to hire achievers, instead of the all the left wing losers now indoctrinating our kids into failed Communism, for nervy, exorbitant tuition.

I doubt such a law would be found constitutional, especially in any state affiliated university. I spent three great years at the University of Iowa. It was a kind of paradise of Americana. I rarely encountered left wing ideology, mostly technical learning took place. More recently, University of Iowa has made the news for left wing politically correct policies.

I suggest another approach than this legislation. It is likely to be constitutional. Punish the universities by slowing, decreasing and withholding funds until the administration is replaced by a more patriotic crew. The legislature can tell the courts, there is just not enough money to go around. They will quietly purge the faculty of partisans disloyal to our American values.

The same tactic should be done at the federal level. End the "in your face" threats of the Trump administration, put in office to clean up;

1) start to stealthily squeeze funding to all disloyal jurisdictions, universities, and other institutions receiving government funding. There is no reason the government has to fund people who want to take down this country. Make the checks later and later, smaller and smaller, and then not coming at all;

2) use the power of audits and regulatory oversight. Given the millions of rules, these have a 100% chance of finding violations;

3) litigation to deter discrimination against current targeted groups;

4) start to impeach appellate judges for their rulings, and not for trivial collateral corruptions;

5) target disloyal legislators, funding primary challengers, Tea party style.

Legal Hoaxing and Its Remedy

Problem.

Legal hoaxing is a term that had to be invented to describe the conduct of the PA DOT. It refers to repeated lying by government to the public about the wording of a law.

1) If a patient is not reported within 10 days of a list of diagnoses, the doctor becomes the legal proximate cause of any accident of his patient. This threat repeatedly made in a widely distributed pamphlet cannot be found in the statute. What can be found are footnotes about cases where doctors were sued for injuries caused by their patients, and were found not liable (see Notes of Decisions; Doctor Liability).

2) The doctor has notice of the law, and the law is not in violation of due process (void for vagueness) because the doctor reports the patient after clinical assessment of ability to drive. Clinical assessment is notice, and rebuts the void for vagueness problem. The law states reporting is mandatory after the diagnosis of a listed condition.

3) The state continually threatens prison sentences. It has never prosecuted a doctor. It preserves all laws with a law prohibiting desuetude. If this law itself has never been enforced, does the law against desuetude apply to itself?

Remedy.

A Rule 11 sanction against individual lawyers, albeit agents of the state, does not seem enough.

The best remedy is a per se summary judgment. If a state has to lie about its law, it constructively admits to its invalidity, ineffectiveness, and inability to pass constitutional muster. To deter legal hoaxing.
